1. Definitions

In these Terms and Conditions, the following terms carry the meanings set out below:

  • "Oakhelm", "we", "us", "our" refers to Oakhelm Legal Advisory, a legal advisory practice registered in Malaysia with offices at 42 Jalan Ampang, 50450 Kuala Lumpur.
  • "Service" refers to all legal advisory services offered by Oakhelm, including but not limited to divorce and separation advisory, child custody representation, and matrimonial asset division.
  • "User", "you", "your" refers to any individual who accesses our website or engages our services.
  • "Agreement" refers to these Terms and Conditions together with any signed engagement letter.
  • "Content" refers to all materials published on our website, including text, graphics, and documents.

2. Acceptance of Terms

By accessing our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you should not use our website or engage our services.

You must be at least 18 years of age and legally capable of entering into binding agreements in Malaysia to engage our services.

3. Service Description

Oakhelm provides family and matrimonial law advisory services in Malaysia, including:

  • Divorce and Separation Advisory under civil and syariah jurisdictions
  • Child Custody and Guardianship representation
  • Matrimonial Asset Division assistance

All services are subject to a formal engagement letter agreed prior to commencement. Nothing on our website constitutes legal advice specific to your situation. Website content is provided for general information only.

4. Client Engagement

A formal client-advisor relationship with Oakhelm is established only upon the signing of a written engagement letter. Until that letter is signed, any information shared with us is treated as confidential but does not give rise to professional obligations on our part.

We reserve the right to decline any engagement at our discretion, including where a conflict of interest exists or where the matter falls outside our practice areas.

5. User Responsibilities

When using our website or services, you agree to:

  • Provide accurate and complete information when requested
  • Not submit false, misleading, or fraudulent information
  • Not use our website for any unlawful purpose
  • Not attempt to gain unauthorised access to any part of our website or systems

Our fees are set out in the engagement letter provided before work commences. The starting fees published on our website reflect the baseline scope of each service. Additional stages, where applicable, will be discussed and agreed with you in writing before being incurred.

Fees are payable in Malaysian Ringgit (RM). Payment terms are specified in the engagement letter. Where payment is not received in accordance with agreed terms, we reserve the right to suspend work on your matter.

8. Service Delivery

We will deliver services with reasonable skill and care in accordance with the Malaysian Bar's professional conduct rules. Timelines for service delivery depend on the nature of each matter, the responsiveness of parties, and court scheduling. We will keep you informed of material developments on your matter.

The scope of each engagement is defined in the engagement letter. Changes to scope will be agreed in writing before additional work is undertaken.

9. Confidentiality

All communications between Oakhelm and clients are subject to solicitor-client privilege. We will not disclose confidential client information to third parties except where required by law, court order, or with your express written consent. For further details, see our Privacy Policy.

10. Disclaimers

Our website is provided for general informational purposes. It does not constitute legal advice and should not be relied upon as such. Legal outcomes in family matters depend on individual circumstances, and we make no representation as to the outcome of any particular matter.

We endeavour to ensure the accuracy of information on our website but cannot warrant that it is current or complete at all times.

11. Limitation of Liability

To the extent permitted under Malaysian law, Oakhelm's liability in connection with services provided is limited to the fees paid by the client for those specific services. We are not liable for indirect, consequential, or incidental losses.

Nothing in these terms limits our liability for fraud, wilful default, or any liability that cannot lawfully be excluded under Malaysian law.

12. Indemnification

You agree to indemnify and hold Oakhelm harmless from any claims, costs, or losses arising from your breach of these Terms and Conditions or your misuse of our services or website.

13. Termination

Either party may terminate an engagement by giving written notice in accordance with the engagement letter. Upon termination, fees for work completed to that point become payable. Oakhelm will provide you with copies of documents held on your behalf on receipt of any outstanding fees.

These Terms and Conditions survive the termination of any engagement to the extent relevant.

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these terms or your use of our services shall first be subject to good-faith negotiation. Where negotiation does not resolve the matter within 30 days, either party may refer the dispute to the courts of Malaysia, with jurisdiction in Kuala Lumpur.

15. General Provisions

  • Entire Agreement: These Terms and any engagement letter constitute the entire agreement between you and Oakhelm regarding our services.
  • Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of the right to do so in future.
  • Assignment: You may not assign any rights or obligations under these Terms without our written consent.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected in a revised "Last Updated" date at the top of this page. Continued use of our website following changes constitutes acceptance of the updated Terms.
